TERMS & CONDITIONS

Access to and use of the website www.preyuk.com (“Prey”), the sale and purchase of products from Prey and any correspondence via e-mail are governed by the terms and conditions set out below. By using Prey and placing an order you agree to accept these terms and conditions.

Prey is operated and owned by Prey Limited, a limited company registered in England & Wales with company registration number 4649081. Prey operates businesses both in high street and online offering retail fashion, fashion accessories, home and lifestyle products and gifts, including its own branded products.

MAKING A PURCHASE

You can buy products from www.preyuk.com. If we accept your order, we will send you an email confirmation as soon as the payment process is completed and a further email on shipment. Orders will only be processed and shipped if all relevant information requested throughout the order process has been entered correctly and the terms and conditions agreed. If the order is deemed incomplete, Prey will send an e-mail to you requesting the missing information. When the information is received by Prey, the order will be deemed complete.

No contract will exist between you and Prey until and unless Prey, or one of its suppliers, dispatches the items ordered. Ownership of the items will pass to you on receipt of full payment and dispatch of the goods from Prey or a supplier. For the avoidance of doubt, receipt of an order via our Site does not constitute acceptance of an order.

Any and all contracts formed will be interpreted, construed and enforced in all respects in accordance with the laws of England and Wales. Prey and you the customer irrevocably submit to the exclusive jurisdiction of the English Courts.

Payment can be made by the following credit or debit cards. Prey will not ship goods until credit cards are authorised.

Credit or Debit Cards accepted are: Mastercard, Visa, American Express, Maestro, JCB, Visa Electron, UK Switch and UK Solo. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not for any reason authorise payment then we will notify you by email and not dispatch the order.

Prices are given in British pounds and include UK VAT for customers living in the European Union and exclude VAT for non EU customers. Where no VAT is included for EU countries, this is because the product has zero-rating in the UK.

While we endeavour to keep our prices as stable as we can, Prey reserves the right to alter its product prices and shipping charges without notice.

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been published with errors including errors in prices and promotions.

Certain (hypertext) links in Prey will lead to websites, which are not under the control of Prey. When you activate any of these you will leave the Prey website and Prey has no control over and will accept no responsibility or liability in respect of the material on any website other than Prey which is not under the control of Prey Ltd.

USER REGISTRATION

When you make a purchase, only your contact details and purchase items are registered with Prey. Your email address will automatically become your user identity and a unique password will be generated and emailed to you. You can change this password if you wish. On subsequent visits to the Site, logging in will then take you to your account allowing you to view past purchases and track active orders. It will also allow Prey to tell you about special offers and other benefits for registered customers. You always have the option to unsubscribe to these notifications at anytime.

SECURE SHOPPING

Prey is committed to a safe and secure on-line shopping experience for you, the consumer. The following is a description of how our on-line shopping technology handles the use of your credit card information.

The Prey online shop uses SSL (Secure Sockets Layer) technology that encrypts all the communication between your web browser and our website. You will notice the Padlock symbol shown on the bottom status bar of you browser.

Having submitted your order you will be transferred to our PayPal account which handles both credit cards and, if you have one, your personal PayPal account. You enter your credit card information directly into the PayPal system.

You will also be given the option of opening a PayPal account. You do not have to take this option. If you do, as with your credit card your account and payment transactions will be governed by the terms you agree directly with PayPal and are wholly independent of
Prey’s terms and conditions.

Please note that your credit card information is never kept on the Prey servers. It is never at risk since it does not reside in any customer order history on Prey’s servers. Should Prey ever be required to refund your purchase funds, our system will access your credit card details within the PayPal secure banking network to reverse the transaction. The reversal of the transaction will then appear on your next credit card statement.

PRODUCT REPRESENTATION

We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you will see depend on your monitor, we cannot guarantee that your monitor’s display will accurately reflect the colour of the product on delivery.

All sizes and measurements are approximate; however we do make every effort to ensure they are as accurate as possible.

SHIPPING & HANDLING

Postage and handling charges will be added to orders. We calculate charges by weight and dimension and apply the appropriate shipping charge.

The cost of the postage and packing will be calculated and displayed with the cost of items in your shopping cart on completion of the questions required before checkout. If you have special shipping requirements we will endeavour to meet these. If there is an additional cost for such shipments we will charge these to your credit card.

Note: Certain items (marked UK only) are not recommended for purchase outside the UK as they are sufficiently heavy that international shipping charges make the final purchase price unrealistic. If you choose to buy such items for shipment outside the UK, please check delivery charges carefully before committing to purchase.

AVAILABILITY

Orders in the UK should be received by you within two working days. Most orders within the EU are received within five days. Other International orders are generally received in 8-10 days.

Delivery dates or lead times are not guaranteed. Deliveries are handled by third party companies, and thus Prey is not able to guarantee delivery dates. However, Prey will do everything it reasonably can to ensure that delivery dates and requirements are met.
Please note that where delivery dates are given, Prey is without liability and time is not of the essence in the contract.

Supply is subject to availability. As there can be a delay between the time when the order is placed and the time when the order is accepted, the stock position relating to particular items may change. If an item you have ordered becomes out of stock before we accept the order you will always be emailed with the option for the order to be back ordered and the likely delivery time or to cancel your order and receive a refund of your payment if you would rather not wait. We usually let you know within 24 hours of our receiving your order of any shortages.

IMPORT DUTIES

There are no import duties for goods shipped within the European Union. Outside the EU any duty and customs charges appropriate to your country are your responsibility.

MATERIAL YOU PROVIDE TO US

If you send Prey ideas, remarks, questions, data, graphics or the like (“Submissions”), these will be deemed to be non-confidential and we will be entitled to use or disclose Submissions in any manner whatsoever, without liability or notice to you. Submissions or any other information you send to Prey should not be, or contain, material which is offensive, pornographic, defamatory, unlawful or likely to infringe any applicable law, whether civil, criminal or religious. You agree that all material submitted to us is original to you, and not copied in whole or part from any third party. Please do not send anything which is required to be kept confidential.

GENERAL

If any part or parts of these terms and conditions are deemed invalid, void or unenforceable, then that part or those parts will be considered severable from these terms and conditions thereby not preventing the remainder from being enforceable or effective.
These terms and conditions may be revised at any time and we reserve the right to do so. You are, therefore, advised to keep up to date with the contents of these terms and conditions as revisions are binding upon you.

Nothing in these terms and conditions will reduce your statutory rights relating to the sale of goods. For further information about UK statutory rights contact your local authority Trading Standards Department or Citizen’s Advice Bureau.
